Statement to ICTI regarding workers illegally ismissed by Wide Ball Sporting Goods Ltd.
Since the investigation in July 2010, we, Student Disney Watch (SDW), have discovered numerous labour rights violations in the Disney supplier Wide Ball Sporting Goods Ltd. Wide Ball is a toy manufacturer certified by the ICTI Care Process. The working conditions of Wide Ball are regarded as compliance with labour laws. However, SDW’s investigation found that, with endorsement of ICTI, Wide Ball is persistently violating the Chinese labour laws. Some of the violations are listed as follows:
1. Only 80 out of 500 workers participate in the Pension Scheme;
2. Deduction of overtime premium. No OT premium for piece rate workers;
3. No regular body check-up arranged for the workers;
4. Forced overtime work;
5. Illegal dismissal of workers.
In September 2010, Wide Ball illegally dismissed workers, namely Xiong Gen-fu, Qing Jian-you, Wu Yu-cheng, Zhou Shu-fang, and Shi Li-xia, without compensation which is required by the Labour Law. After the rights-defending actions of the workers, Wide Ball only paid part of the compensation. After SDW’s report on the dismissal case was released in November 2010, ICTI coordinated the negotiation between Wide Ball and the 5 workers. The 3 parties, Wide Ball, the workers and ICTI came to the negotiation table on 4 January 2011. Regrettably, the 5 workers refused to accept the terms of Wide Ball, which is only 25% of the legal standard of compensation.
As a follow-up investigation, workers experience that the ICTI inspections are “merely perfunctory”. ICTI auditors are described easily distracted by the forged materials provide by Wide Ball and could not discover the real working conditions of the workers. On the contrary, workers’ lives are disrupted by the inspections. To hide from the auditors, the workers have to cover their utensils and personal belongings to make their dormitories look “clean and tidy”. Workers have to dine out because of the inspections, which increase the living cost of workers.
There is no doubt that Wide Ball is violating the Chinese labour laws, and also the ICTI Business Code. SDW urges ICTI to be responsible to the workers and facilitate the compensation from Wide Ball in compliance with legal standard. SDW also demands ICTI to take its audit with due diligence and to check beyond deceptions of the factories.
